THE CRUISE-IN PROMOTION TERMS AND CONDITIONS
NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE THE CHANCES OF WINNING.
Agreement to Rules: By participating, you agree to be fully unconditionally bound by these Rules, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of Sponsor, as final and binding. The Promotion is subject to all applicable federal, state and local laws.
Eligibility: This Promotion (the “Promotion”) is open to those who create an account on the Cruise-In at www.thecruise-in.com (the “Website”) and who are 18 or over as of the date of entry. The Promotion is only open to legal residents of the United States of America and the District of Columbia. Employees of Mozaic, Inc. (the “Sponsor”) and its affiliates, subsidiaries, advertising and promotion agencies, suppliers and their immediate family members and/or those living in the same household of each are not eligible to participate in the Promotion. Void where prohibited.
Promotion Period: The Promotion will begin at 12:01AM EST on January 1st, 2022 and a drawing will take place on the 31st day of January, 2022 11:59PM EST (“Promotion Period”).
How to Enter: How to Enter: All users of the Website who have created at least one car page as of 11:59PM EST January 31st 2022 will be automatically registered in the drawing. Each user may only be entered once.
If a user of the Website does not wish to be considered, he or she must opt out by emailing or calling the Sponsor by the drawing date, otherwise entry constitutes consent to participate.
Odds of Winning: All entries in the Promotion have an equal chance of winning. Odds of winning a Prize depend on the number of eligible entries.
Winner Selection: Winners of the Promotion will be selected in a random drawing by the Sponsor at 11:59PM EST on January 31st 2022 from all eligible entries received. Winner will be notified via the phone number or email address associated with their user account and through notification to their user account through the Website within 48 hours of the drawing. If a Promotion winner is not eligible to win, or if the Prize is not claimed within 72 hours, the Prize will be forfeited and an alternate winner may be selected. Sponsor shall have no liability for a winner’s failure to receive notices due to winners’ spam, junk e-mail or other security settings or for winners’ provision of incorrect or otherwise non-functioning contact information. The receipt by winner of the prize offered in this Promotion is conditioned upon compliance with any and all laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (AT SPONSOR’S SOLE DISCRETION) WILL RESULT IN SUCH WINNER’S DISQUALIFICATION AS WINNER OF THE PROMOTION.
Prizes: Winners will receive a gift card valued at $500 (“Prize”). The specifics of the prize shall be solely determined by the Sponsor. Prize winners are responsible for any expenses incurred in connection with the prizes. No substitution, or transfer of Prizes is permitted, except that the Sponsor reserves the right to substitute a prize of equal or greater value in its sole discretion. All federal, state and local taxes on Prizes are the sole responsibility of the winner.
Use of Winner’s Name and Likeness: Acceptance of the Prize constitutes permission for Sponsor to use winner’s username, name, likeness, profile information, photos and content he or she has uploaded to the Website and other information provided in connection with this Promotion (“Name and Likeness”) for purposes of advertising and trade without further compensation, unless prohibited by law. Winner expressly consents to Sponsor and Sponsor’s successors and assigns’ right to use its Name and Likeness without any further notice, review or consent to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter in perpetuity and throughout the world. Winner represents, warrants and covenants that it owns all right, title and interest in and to all content and photos he or she has uploaded to the Website, and Winner shall indemnify, defend, and hold harmless Sponsor from and against any claims of infringement, misappropriation or violation of any intellectual property, privacy, or other similar or related rights of any third party.
Terms: Sponsor reserves the right, in its sole discretion to cancel, terminate, modify or suspend the Promotion should (in its sole discretion) a virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Promotion. Sponsor reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Promotion or Website or violates these Terms & Conditions and to seek damages to the fullest extent permitted by law.
Limitation of Liability/Release: By entering the Promotion, each entrant (including, but not limited to, each winner) agrees to release and hold harmless Sponsor and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) entrant’s participation in the Promotion and/or his/her acceptance, possession, use, or misuse of any Prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error which may occur in the administration of the Promotion or the processing of entries.
Entrant agrees to release and hold harmless Facebook, its parent companies, subsidiaries, affiliates and related companies, and each of its officers, directors, employees and agents (collectively, “Facebook Released Parties”) from and against any and all liability. Facebook and the Facebook Released Parties are in no way connected or affiliated with Sweepstakes, Sponsor.
Disputes: THIS PROMOTION IS GOVERNED BY THE LAWS OF THE STATE OF OHIO WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Promotion, participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Promotion, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Hamilton County, Ohio. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys’ fees, other than participant’s actual out-of-pocket expenses.
